HRERA vs UP-RERA

The statutory duty is identical because both authorities enforce the same central Act; what differs is administration, jurisdiction and how each authority behaves in practice. Quote a valid registration number in every advertisement, register your agents with the right authority, and keep a compliance checklist per state rather than assuming one approval covers both.

The real difference

Both authorities operate under the Real Estate (Regulation and Development) Act, 2016. The core advertising obligation is the same: no marketing of an unregistered project, and the registration number plus the authority’s website reference has to appear in the advertisement itself. The Act provides for substantial penalties for advertising an unregistered project, calculated as a share of estimated project cost, so this is not a formatting preference.

What differs is structure. Haryana runs its regulator with separate benches, with Gurugram handling the projects most NCR marketers care about and Panchkula covering the rest of the state. Uttar Pradesh runs a single authority for the whole state, which is what governs Noida, Greater Noida, Ghaziabad and Yamuna Expressway inventory.

Two portals, two registration formats, two sets of circulars. Rules and circulars are updated periodically, so verify current requirements on the relevant authority portal before a campaign goes live.

The agent side is where most trouble actually starts. Developers sign channel partners quickly during a launch push, creative goes out across dozens of handles, portals and WhatsApp groups within a week, and nobody stops to check whether each of those partners holds current registration with the correct authority. Check first. It takes an afternoon.

Advertising a Haryana project

You are dealing with the Haryana authority, and for most Gurugram, Faridabad and Sohna inventory that means the Gurugram bench. Get the project registration number, confirm it is current, and put it on every asset: hoarding, brochure, landing page footer, Meta creative, Google responsive display, portal listing.

Agents selling in Haryana need their own registration with the Haryana authority. A channel partner registered elsewhere is not covered by that, and developers get pulled into their partners’ non-compliance regularly. Match every claim to the sanctioned plan. Clubhouse, school, metro connectivity: if it is not approved and committed, it should not sit in the creative, however common that practice has become in Dwarka Expressway advertising.

Keep an approvals file. Sanctioned plan, registration certificate, current validity, the exact wording approved for possession timelines. When a portal or a channel partner runs creative on your behalf, that file is what protects you, because the developer is usually the one answering for a partner’s shortcut.

Advertising a Uttar Pradesh project

One authority for the whole state, so a Noida launch and a Lucknow launch sit under the same regulator and the same portal. The UP authority has been notably active on agent registration and on pulling up advertisements that omit registration details, so treat the number as a design element you plan for, not something squeezed into six-point type at the end.

Practical points that catch marketers out: the project webpage on the authority portal should be referenced, possession timelines in creative must match what is registered, and carpet area is the measure to quote. Selling Noida inventory to a Gurugram audience does not move you under Haryana’s regulator, but your agents still need the correct state registration for the project they are selling.

Watch the resale and rental advertising too. A large share of listings for Noida and Greater Noida inventory are put up by agents rather than developers, and the obligation to be registered sits on the agent, whatever the arrangement with the seller. Verify before you let anyone list under your brand.

The practical compliance approach

Build one checklist per authority and attach it to your creative approval step, before anything is published. Registration number, authority portal reference, agent registration, claims matched to sanctioned plans, timelines matched to filings.

Then have somebody re-verify quarterly, because registrations lapse and circulars change. This is not legal advice; for a specific campaign, confirm current requirements with the relevant authority or your legal counsel. The cost of doing that is trivial next to a penalty computed on project cost.

Practically, the difference between the two states is administrative rather than philosophical. Different portal, different number format, different bench. Same duty. Anyone telling you one regulator is lenient is describing enforcement history, not the law, and enforcement history changes.
